Irrespective of what one thinks of Varun Gandhi, there is general unanimity among politicians of all hues, media, legal personalities and intelligentsia that slapping of National Security Act against Varun Gandhi was a misuse of the Act. The Apex Court’s decision revoking the NSA against Varun was expected. But an irreversible damage is done to Varun in the meantime. Who will compensate for the precious 20 days of the young politician which he needlessly spent in the jails of Pilibhit and Etah?
If the legal fraternity and the Delhi High Court Bar Association can take law in their hands and scuttle the notification of a good law passed by the parliament, as they did with the amendment to Section 41 of the Criminal Procedure Act, why can they not protest against the existence of anti-people draconian laws in our statute-book? Surely they are aware that laws like POTA and MCOCA are rampantly misused as instruments of harassment or vendetta.
