India is facing its worst and the most dangerous constitutional crisis. Th doubtful and dis-reputed (SIR) has deprived more than 10 crore genuine voters of their basic democratic right of exercising their adult franchise. This is the basis of democracy and the spirit of the Constitution of India. Chief Election Commissioner Gyanesh Kumar is clearly responsible for this anti-democratic crime.
Democracy is based on the free will of the citizens which they show through their votes in free and fair elections. If a government or its agency deprives the bona-fide citizens of their free will, it is tantamount to destroying democracy. The CEC Gyanesh Kumar has committed this crime by depriving large numbers of citizens of their right to use their franchise.
All Opposition parties are united in their struggle to restore this fundamental right of Indian citizens. Therefore, in one voice, they are opposing the CEC and asking the government to book a case against him and start a legal process against him. Already a petition in this regard is before the Lok Sabha. But the Speaker is sitting on this, obviously on the instruction of the BJP regime.
The two other Election Commissioners, Mr. Vivek Joshi and Mr. Sukhbir Singh Sandhu have clarified that the CEC had been taking arbitrary decisions in spite of their objections which they registered during the last 10 months. They have done their duty by objecting to the CEC’s autocratic style of functioning.
Opposition parties and especially the recently formed Cockroach Janta Party (CJP) have elaborate plans to start protests at Jantar Mantar, but the frightened ruling BJP is hell bent upon not allowing any agitation. It is unfortunate that the Supreme Court, the guardian of our Constitution, to use the words of Yogendra Yadav, is on the silent mode and not taking suo motto cognizance of the murder of democracy and suppression of the spirit of the Constitution.
The government is squarely responsible for the open misconduct of Mr. Gyanesh Kumar. Depriving genuine voters of the use of their voting right clearly amounts to derailment of the democratic process.
If the government does not reform itself and insist on its fascist and authoritarian attitude and thereby depriving people of their rights and throwing India into a chaotic situation, the only alternative is peaceful, constructive and massive protests. All indications show that the government is not ready for any amends. But how long the government will resist the anger of Gen Z and all other sections of people. The all out and all around failure of the government and resort to dictatorial tactics on its part will further complicate the already stormy situation.
Let us hope that the government takes immediate corrective steps and changes its attitude. If so, it would avoid any unwelcome chaos and confrontation. May God give the ruling regime good sense and wisdom to honour the spirit of democracy and Constitution. India cannot tolerate further damage to basic human values, true and genuine democracy and free and fair elections.
