The Apex Court, on 25 March, ruled that an institution would be considered a minority institution as long as it is being run and administered by members of the minority community. Dismissing a petition filed by DAV College Trust and Management Society to enjoy the minority status on the ground of linguistic minority, a Bench of Justices SS Nijjar and MY Iqbal said the concession under Article 30 is not absolute but subject to restrictions and members of a linguistic minority in one state cannot continue running a trust while staying in another state where they are not in minority. The Bench added that the State Government and Universities can issue direction from time to time for the maintenance of standard and excellence of such institutions.
