In a major legal development regarding the historic Muslim Kabristan and Karbala land in Dabri (Khasra No. 27/19, Pocket 20-D, Dwarka), the Dwarka Court, Delhi, has issued interim directions for the protection of graves. The Court has also directed DDA and Delhi Waqf Board to present detailed records pertaining to land ownership and demarcation.
On Sep. 2, the Court admitted the suit and issued notices to all defendants. However, local residents allege that following the issuance of notices, the DDA hastily installed a gate on the Karbala land without finishing civil work and accelerated construction activities.
News of the gate’s installation sparked severe anger among local residents, who gathered at the Kabristan and Karbala site to hold a peaceful protest. Counsels for the plaintiff immediately rushed to the court, but the presiding judge was unavailable in the second half of that day. Subsequently, Adv. Raees Ahmad, Adv. Shiv Kumar Chauhan, and Adv. Aslam Ahmad (Advocate-on-Record, Supreme Court), along with their legal team (Advs. Jayant Tiwari and Sheela Kaushik), reappeared before the Court on Sep. 5, requesting an early hearing due to the extreme urgency of the matter.
The plea expressed severe concerns over illegal interference, dumping of debris, parking of heavy vehicles, and ongoing digging and construction activities damaging existing graves and an old tube well at the sacred site.
