Equality and Justice along with Liberty, Unity and Fraternity of Entire Humanity, when quoted as having been conceived first time in human history by Islamists, some of our compatriots and even highly educated intellectuals, who oppose everything and anything in Islam and Muslims for the sake of opposition, reject this fact as lie and falsehood. They harp on the propaganda, without supporting arguments or specific reasons, simply raising a hue and cry that Non-Muslims and Women are discriminated against in Islamic Law.
It is 100% true that rules and guidelines concerning Muslims in contrast to Non-Muslims as also Men in contrast to Women are different in nature in Islam as they should be in any comprehensive, tolerant and pluralistic legal, social, political or economic system, which is practical unlike any theoretical, monolithic or unscientific thinking.
It is a figment of imagination to have a practical law based on the unnatural assumption that every citizen of a state, whether man or woman and whether he subscribes to any particular faith or not, should be governed by applying exactly the same rules and regulations.
We are aware that both physically and psychologically, males and females are not similar. In Islamic guidance man is given role of protector, guardian and economic supporter of entire family irrespective of the wife’s earning status.
Wife can retain her earnings entirely to herself. They are exempted from regular prayers at mosque as a privilege and not as a restriction. We know women praying even in Mosques including Ka’ba, where areas are marked for them.
It is desirable for a man to have more than one wife not only because of his psychological and biological needs, but also to take care of numerous destitute women and widows, becoming a burden in many situations. These situations include existence of lower male to female ratios although everywhere due to exposure of males to wars and other occupational hazards.
Islam bashers do not understand that it is this final divine law which envisaged property rights for woman from all her blood relations as also provision for her right of divorce and remarriage.
We often hear proud declarations that Raja Ram Mohan Roy with the help of Benting, a British viceroy, made provisions for divorce law and remarriage, which is considered an advanced feature of modern law. They forget that it has been the privilege of Muslims for over fourteen centuries.
If one makes an independent study of provisions in Islamic law for both women with respect to men and Non-Muslims with respect to Muslims, it will be concluded that Muslim women over men and Non-Muslims over Muslims have more concessions and rights.
Due to misinformation many are carried away to think that imposition of special tax on Non-Muslims, who are not included in Islamic army is despotic. In an Islamic administration every Muslim pays 2.5% Zakat, whereas a Non-Muslim pays 1% Jizia in exchange of protection.
