Noormohammed Shaikh has filed a petition in the Gujarat High Court, after a metropolitan court rejected his plea to initiate a criminal proceeding against Gujarat chief minister Narendra Modi and former VHP leader Kaushik Mehta for the bandh call in the city, a day after Godhra train incident in 2002.
Shaikh challenged the lower court order and sought punitive action against the accused. The metropolitan court took eight long years to reject Shaikh’s complaint. Sheikh, a resident of Dariapur, had filed the application in October 2002, and the magisterial court rejected it in 2010. Shaikh had based his complaint against Modi and Mehta on a verdict by the Supreme Court, which held bandh calls unconstitutional and illegal.
