The Nanavati Commission probing the 2002 Gujarat riot cases has told the Gujarat High Court that its decision not to summon Chief Minister Narendra Modi was not final and may call him for questioning. The Commission was clarifying its position while responding to a poser by the High Court on March 22, that whether its decision not to summon the BJP leader for questioning was tentative or final. Chief Justice S.J. Mukhopadhaya and Justice Akil Kureshi in their order said, “The Commission’s letter says that its order of September 18, 2009 is not final.” The Supreme Court-appointed Special Investigation Team (SIT) has already questioned Modi on March 27, on a complaint in connection with the Gulberg Society massacre. Earlier in November last year a single bench of Justice K.S. Jhaveri dismissed Modi’s petition saying that the Commission has not completed its inquiry and still has power to summon Modi under Section 8(b) of Commissions of Inquiry Act.
