The Babri debacle is all but the doings of the Congress party. It is how politics works. One may sarcastically call it the art of governance. It was started in the Nehru regime, it got the boost up in the Rajiv period and now the current fiasco in the Sonia management is in the same vein. Narsimha Rao as a true party-man also played a similar role.
Another aspect which may be considered is the dilemma of the judiciary when it feels that the administration of the state cannot execute its verdict. Perhaps, in that case, the judiciary obliges by providing a decree that is ‘executable.’ We have a number of cases of vexed cases where the rulings of the courts could not be implemented by the administration. Take the recent case of free distribution of food grains. The administration initially took recourse to the opinion that what the Court has said is merely suggestive in nature. However, the Court reasserted that it meant business. Even then, it could not be executed.
In the Babri case the lower courts, up to the High Court, kept it deferred for more than six decades and now the matter has been simply slipped to the Supreme Court’s domain. May be the judiciary did not find any other way out!
