The Bar Council of Malaysia has decided to file a civil suit against the government, Inspector-General of Police Tan Sri Musa Hassan and Brickfields police chief ACP Wan Abdul Bari Wan Abdul Khalid for unlawful detention of five Kuala Lumpur Legal Aid Centre (LAC) lawyers during the candlelight vigil for Bersih activist Wong Chin Huat last week. After the council’s extraordinary general meeting (EGM) held at the Civic Centre and attended by 1,400 lawyers, its president Ragunath Kesevan said the police had no right to detain the lawyers who were there to provide legal aid for those arrested during the vigil as Section 28A(4) of the Criminal Procedure Code (CPC) allows the people access to legal aid. Ragunath said the council had demanded an apology after the incident but the attempt by Home Minister Datuk Seri Hishammuddin Hussein to say that lawyers are not above the law was not a reply and a solution.
